Duterte faces another DQ case

Davao City Mayor Rodrigo Duterte is now facing another disqualification case after the Commission on Election (Comelec) confirmed it has officially accepted the petition filed by Eli Pamatong against him.

Comelec Commissioner Rowena Guanzon said they are now considering merging the petition filed by Pamatong to the cases filed by broadcaster Ruben Castor, nuisance presidential candidate Rizalito David, and University of the Philippines (UP) Student Council chairman John Paulo Delas Nieves.

She said this is part of the poll body’s initiative to speed up the resolution of the Durterte’s case.

“The en banc is now deliberating. It is considering consolidating all the cases of Mayo Duterte,” Guanzon told reporters in an interview.

“Our objective is to finish (its deliberation) in Comelec at the best possible time so they elevate it to the Supreme Court,” she added.

Pamatong’s petition was not immediately received by Comelec after he failed to pay the P10,000 filing fee.

In a related development, Guanzon said Duterte’s camp could still file a petition to stop the consolidation of the four disqualification cases.

The poll official made the statement after Vitiliano Aguirre, the legal counsel of Duterte, said they are against the joining of the cases since Castor’s petition is already set to be resolved by the Comelec First Division.

In case the Comelec First Division decides to push though with the consolidation of the four cases despite the opposition, Guanzon said Durterte’s camp could fast-track their resolution of his case by shortening the allowable period, wherein they could file their response.

“Instead of 10 days, they could agree to file their memorandum in five days,” Guanzon said.

The First Division is scheduled to conduct a hearing on the cases against the standard bearer of the PDP-Laban next Tuesday, January 12.

“By next week we will know of the cases will be consolidated or not, to be fair to the candidate we have to resolve this immediately,” Guanzon said.
